Terms of Service

1. Agreement

By creating an account or using KernelKin (the “Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

KernelKin provides AI-assisted family tools, including messaging, memory storage, and memorial profiles that can generate text and synthetic speech responses. Features may change, and some (such as live peer video calling or talking avatars) may be labelled as limited, notify-only, or coming soon until fully available.

3. Accounts & eligibility

You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account. The Service is intended for adults; child-related features require a parent or legal guardian where applicable.

4. Memorial & likeness content

• You may only upload memories or create a memorial voice for a deceased person if you have the legal right and family authority to do so.
• AI memorial replies and voices are synthetic recreations for private family remembrance — not the deceased person, not a substitute for counselling or estate advice, and not for fraud or public impersonation.
• You must not use memorial features to harass, deceive, or commercially exploit a likeness without lawful basis.

5. Acceptable use

Do not misuse the Service: no unlawful content, no attempts to circumvent security, no scraping or reverse engineering beyond fair use exceptions, and no uploading of malware or others’ private data without permission. We may suspend accounts that violate these Terms.

6. Subscriptions & payments

Paid plans are billed through our payment provider. Fees, renewals, and cancellations follow the plan terms shown at purchase and any applicable App Store / Google Play billing rules.

7. Intellectual property

KernelKin branding, software, and UI remain ours or our licensors’. You retain rights in content you upload, and grant us a limited licence to host, process, and display it as needed to operate the Service (including AI analysis you request).

8. Disclaimers

The Service is provided “as is”. AI outputs may be inaccurate or incomplete. We do not guarantee uninterrupted availability. To the fullest extent permitted by law, we disclaim warranties not expressly stated here.

9. Limitation of liability

To the fullest extent permitted by law, Lumaverse AI Group Ltd is not liable for indirect, incidental, or consequential damages, or for losses arising from memorial AI use, lost data, or reliance on generated content. Mandatory consumer rights in your jurisdiction remain unaffected.

10. Changes & contact

We may update these Terms by posting a new version with an updated date. Continued use after changes means you accept them. Contact us via in-app feedback or the operator details on the store listing.
